These Terms of Use (“Terms”) govern your use of the NightLight Nurse website and services. By accessing this website or engaging in services, you agree to be bound by these Terms.

If you do not agree, you should not use this website or services.

1. Nature and Scope of Services

NightLight Nurse provides nurse-led, educational sleep support services for infants and young children, generally within the age range of approximately 3 to 36 months.

Services may include:

  • Video or phone consultations

  • Written sleep plans or educational materials

  • Asynchronous messaging or email support

  • General guidance related to infant sleep and family routines

Services are individualized and supportive in nature. Outcomes are not guaranteed, and results vary based on many factors outside our control.

2. Not Medical Advice

NightLight Nurse services are not medical care and do not replace care from a pediatrician or other licensed healthcare provider.

We do not:

  • diagnose medical conditions

  • prescribe medications

  • provide treatment for illness or disease

Clients are responsible for maintaining appropriate medical care for their child.

Emergency situations:
Our services are not appropriate for emergencies. If a child is experiencing symptoms such as difficulty breathing, fever, dehydration, failure to thrive, or other urgent concerns, clients should seek immediate medical attention or contact emergency services.

3. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information

  • Participate in services in good faith

  • Understand that implementation of recommendations is voluntary and ultimately the client’s responsibility

Incomplete, inconsistent, or non-implementation of recommendations may affect outcomes and does not constitute grounds for refund or liability.

4. Communication and Response Times

Services may include asynchronous communication. Messaging access does not constitute real-time or on-demand support.

While we strive to respond within two business days, response times may vary due to workload, illness, holidays, or other circumstances. Occasional delays do not constitute a failure of service.

5. Payments and Refunds

Payment is required prior to the start of services unless otherwise agreed.

Because services involve personalized consultation, preparation, and professional support, refunds are not automatically provided.

Refund requests may be considered on a case-by-case basis after services have begun and after a good-faith effort has been made to implement agreed-upon recommendations and utilize the support provided.

Refunds will not be issued due to:

  • exhaustion or emotional distress

  • a change of mind

  • early discontinuation

  • incomplete or inconsistent implementation

Once a consultation or personalized plan has been delivered, services are considered rendered. Any refund determination, including the amount, is made at the sole discretion of NightLight Nurse.

6. Intellectual Property

All materials provided, including but not limited to:

  • written plans

  • guides

  • educational documents

  • communications

are the intellectual property of NightLight Nurse and are provided for personal use only.

Materials may not be copied, shared, reproduced, distributed, or resold without prior written permission.

7. Termination of Services

NightLight Nurse reserves the right to pause or terminate services if a client engages in behavior that is abusive, inappropriate, unsafe, or inconsistent with a respectful working relationship.

This decision will be made thoughtfully and with care, but NightLight Nurse is not obligated to continue services where the professional relationship has broken down.

8. Limitation of Liability

To the fullest extent permitted by law, NightLight Nurse shall not be liable for any indirect, incidental, or consequential damages arising from the use of this website or services.

Clients acknowledge that parenting decisions remain their responsibility and that services are advisory and educational in nature.

9. Geographic Scope

Services are intended for clients located within the United States. We make no representations regarding suitability or compliance outside this jurisdiction.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

11. Privacy

Use of this website and services is also governed by our Privacy Policy, which is incorporated by reference.

12. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last updated” date. Continued use of the website or services after changes are posted constitutes acceptance of the revised Terms.
